New License Agreement Requirements FAQ
 

General

The license agreement had not been fully updated in many years and several versions were in use by various licensees. While most of the new agreement is the same, the new version simplifies and standardizes terms for all Product Certification Program (PCP) participants and incorporates the current certification programs by reference, complies with ANSI accreditation requirements, and clarifies the requirements for use and display of NFRC’s certification mark and other trademarks.

There must be a signed PCP license agreement for any company to participate in the PCP. Without a legal agreement between NFRC and your company, you cannot participate in the program. 

With hundreds of participants in the PCP, it is essential to the integrity of the program and fairness to the participants that all licensees sign the same form of license agreement.  Therefore, the terms of the agreement cannot be modified, and changes are not being accepted.

As noted above, for legal and practical reasons, all NFRC licensees must be under this new license agreement.

If you have questions about language in the license agreement, please contact NFRC's quality and compliance team at compliance@nfrc.org. If necessary, NFRC staff will contact NFRC legal counsel for legal explanation.

In order to comply with the certification program requirements, ANSI National Accreditation Board (ANAB) requirements, and the rules regarding use of NFRC certification marks, NFRC needs the requested information about where certified products are being manufactured, whether that manufacturer is affiliated with the licensee, and whether licensee’s certified products are being labeled and distributed under company and product names different than what is reflected in the certified product directory.

To remain in good standing, all license agreements must be signed and returned to NFRC by DATE.
