Waiver / Exemption Request Form - Type 2


Product Lines are required to accurately reflect the current product construction and to be recertified every 5 years per the NFRC rules.  In rare instances, NFRC may grant a waiver, or exemption for special circumstances surrounding a product line.

All requests and reviews shall follow the requirements of the
NFRC 7019 - PCP Extension and Waiver Process.
Unlike extensions, waivers shall not affect the expiration dates of product lines.
Type 2 Waivers may be requested where additional time is needed to simulate, test, and/or validate changes in design or component substitutions for revisions to currently certified product lines in the CPD or where new technologies used to replace current or obtain new certifications that cannot otherwise seek certification through the current product category requirements; however, can meet the necessary mandatory rating requirements.
Type 2 Waiver/Exemption
 
Type 2 Waivers may be requested where additional time is needed to simulate, test, and/or validate changes in design or component substitutions for revisions to currently certified product lines in the CPD or where new technologies used to replace current or obtain new certifications that cannot otherwise seek certification through the current product category requirements; however, can meet the necessary mandatory rating requirements .
Type 2 requests shall fall into one of the following categories:
  1. Engineering/design changes/component substitutions.
  2. New technologies that may not currently meet the requirements for use and certification in the NFRC Product Certification Program.
  3. Additional time is needed to simulate, test, and/or validate revisons to currently certified product lines.
Type 2 Waiver Documentation Required:
  1. Component identification, model number, series, or product identification.
  2. Component description and intended use in certified product lines.
  3. Proof of equivalency: Tolerances for allowable equivalent substitution are an increase of ≤0.005 for U-factor or a change of not more than +/- 0.04 for SHGC.
  4. If a new technology, data provided through simulation and/or physical testing by a NFRC recognized laboratory proving the product can, at minimum, be rated for all the mandatory ratings for the product category.

All exemption requests will be evaluated based on merit and may not be granted if sufficient rationale is not provided.
If the request is denied, the product line shall be updated as per the NFRC rules before products may be labeled.
